Terms and conditions for all entries

Contest Declaration European Press Prize 2020

I declare that,

1. I have read, understood and accepted the entry rules of the European Press Prize 2020 and by submitting one or more projects I agree to comply with the rules, timetable and procedures of the European Press Prize 2020 and I acknowledge to be bound by this declaration;

2. I hereby guarantee that I am the sole copyright holder of the project(s), or guarantee that I have been fully authorised by the (other) copyright holder(s) of the submitted projects(s) to: a. submit the project(s) to the European Press Prize 2020; and b. to agree to and accept the contest rules and this declaration on the (other) copyright holder(s)’s behalf;

3. Insofar I am not the (sole) copyright holder of the project(s) submitted, I acknowledge and accept full responsibility for obtaining, prior to submission of the project(s), any and all releases and/or (written) consents and/or waivers of moral rights, necessary to permit entrance to the contest, the grant of the license and/or the use of the article(s) by the European Press Prize 2020 as stipulated in this declaration;

4. I understand that the author(s) of the projects article(s) shall retain any and all copyright vested in the work;

5. I guarantee the submitted project(s) do not infringe upon third party’s rights including but not limited to copyright, moral rights any other intellectual property rights and/or other title and interest and that no third party can object to the use of the project(s) submitted by the European Press Prize as stipulated in this declaration;

6. In as far as permitted under the relevant national, international laws and treaties, I hereby irrevocably waive in favour of the European Press Prize any and all moral rights vested in the submitted article(s), such as but not limited to the right to be identified as the creator of a work, the right to oppose the communication to the public of the works under a name other than his own and any alteration in the name of the works or the indication of the author, the right to object modification, distortion, mutilation and/or derogatory action in relation to the project(s) I have.

7. Notwithstanding Article 7, I shall refrain from invoking moral rights insofar they cannot be waived under the relevant laws and treaties or that I have obtained the written and signed consent of the (co-)author(s) of the submitted project(s) that they shall refrain from invoking their moral rights against the European Press Prize;

8. Specifically for the European Cartoon Award:

I hereby grant an irrevocable, perpetual, worldwide non-exclusive license to the European Press Prize and Studio Europa Maastricht to: publish, distribute, or otherwise making available, reproduce, adapt, translate, summarise, display, store, archive, create derivative works of the submitted cartoon(s) (along with a name credit) in connection with the European Press Prize 2020; and exhibit the cartoon(s) in Europe and beyond; and promote the under (i) and (ii) mentioned disclosures in any and all media now or hereafter known including but not limited to print, digital, online (e.g. social media) or broadcast, for no additional remuneration including but not limited to a royalty.

European Press Prize is entitled to transfer its right mentioned under (ii) and/or to grant a third party the right to execute this right or to grant a license thereto.

For all other awards:

By entering the European Press Prize 2020, I hereby grant an irrevocable, perpetual, worldwide non-exclusive license to the European Press Prize, to publish, distribute, or otherwise making available, reproduce, adapt, translate, summarise, display, store, archive, create derivative works of the submitted project(s) (along with a name credit) in connection with the European Press Prize 2020 and promotion thereof in any and all media now or hereafter known including but not limited to print, digital, online or broadcast, for no additional remuneration including but not limited to a royalty;

9. By entering the European Press Prize 2020, I authorise the unrestricted use of author’s portrait, name and likeness and any and all statements made by myself and/or the (co)author(s) of the submitted article(s)in relation to the entrance of the European Press Prize 2020;

10. I acknowledge and agree that the European Press Prize is not required to a. compensate me or the author(s) of the submitted project(s) for the waiver as described in article 7 and/or the granted license as described in Article 8 and 9; b. seek prior approval for the use as described in Article 8 and 9;

11. I accept full responsibility and full liability for the article(s) submitted to the European Press Prize 2020 by me. I acknowledge and agree that I shall fully indemnify and fully hold harmless the European Press Prize and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any and all claims, losses, and damages arising out of my participation and/or submitted project(s) to the European Press Prize 2020 and/or any activities related thereto.

12. I acknowledge and explicitly agree all personal data including but not limited to the name and address of the author(s) of the submitted project(s), may be processed, shared, stored and otherwise used for the purposes and within the context of the European Press Prize 2020.
